Excel ER Social Media Policy

Purpose:

The purpose of this policy is to help employees, guests and participants understand how Excel ER policies apply to social media. The absence or lack of explicit reference to a specific site does not limit the extent of the application of this policy. Guidelines for Social Media for EXCEL ER Employees:

Official postings on behalf of EXCEL ER are made only on the official EXCEL ER Facebook, LinkedIn, Twitter, website, and any additional social media sites that may be developed by EXCEL ER in time. Please contact Encore Multimedia if you wish to have information about your department or Excel ER activities posted to one of our official sites.

Unless you have the written consent of Executive Management, you must at all times adhere to the policies and procedures of EXCEL ER with regard to the confidentiality and release of patient information and may not post any content that is confidential or proprietary information about EXCEL ER. You must maintain patient privacy at all times and may not post any patient identifying information, including but not limited to patient images without the express written consent of the patient. Even if an individual is not identified by name within the information you wish to use or disclose, if there is a reasonable basis to believe that the person could still be identified from that information, then its use or disclosure could constitute a violation of the Health Insurance Portability and Accountability Act (HIPAA) and EXCEL ER policy.

You may not use the social media sites to provide medical advice or medical commentary or use the social media sites to make or recommend referrals to physicians. You must write in the first person, where your connection to EXCEL ER is apparent and make it clear you’re speaking for yourself and not on behalf of EXCEL ER. If an individual wishes to create a social media site for his or her own department, they must have approval by Encore Multimedia and Executive Management.

Be professional, use good judgment and be honest in your communications. Errors, omissions or unprofessional language or behavior reflects poorly on EXCEL ER, and may result as EXCEL ER’ liability. “Friending” of patients on social media sites is strongly discouraged by EXCEL ER. Staff in patient care role should not initiate or accept friend requests or conversations on social media unless the in-person friendship pre-dates the treatment relationship.

Guidelines for photography, video and audio recording

To protect the safety and privacy of our patients, physicians and staff, no photography, video or audio recording is allowed inside EXCEL ER facilities or on campus without the prior written permission of the EXCEL ER and Encore Multimedia.

Guidelines for Personal Profiles:

As supporters of social media, EXCEL ER views personal websites and blogs as an appropriate outlet; however, we ask that you be smart with your participation in online activities and adhere by the following guidelines. Your online activities reflect on both EXCEL ER and you.

Guidelines for Interaction About The Organization on the Internet

If you are developing a personal Web site or writing a blog that will mention Excel ER or any of its affiliated entities (collectively referred to as the “Organization”), employees, partners, or vendors, identify that you are an employee of your Organization and that the views expressed on the blog or Web site are yours alone and do not represent the views of the Organization. Unless given permission by your manager, you are not authorized to speak on behalf of the EXCEL ER, nor to represent that you do so.

Confidential Information Component of the Blogging Policy

You may not share information that is confidential and proprietary about EXCEL ER or any affiliated entity. This includes information about finances, patient census, number of employees, organizational strategy and any other information that has not been publicly released by EXCEL ER. Of course, you must maintain all EXCEL ER confidentiality and proprietary information policies, HIPAA, etc.

These are given as examples only and do not cover the range of what the organization considers confidential and proprietary. If you have any question about whether information has been released publicly or doubts of any kind, speak with your manager and Encore Multimedia before releasing information that could potentially harm the organization or current and potential employees, partners and vendors.

The organization’s logos and trademarks may not be used without explicit permission in writing from the organization. This is to prevent the appearance that you speak for or represent the organization officially.

Respect and Privacy Rights Components of the Blogging Policy

When speaking about the organization and current and potential employees, partners and vendors, be respectful and do not engage in name calling or behavior that will reflect negatively on EXCEL ER or its employees’ reputation. This is not to be construed as restricting the flow of useful and appropriate information or in engaging in protected concerted activity, but rather is to protect against defamatory, discriminatory, harassing or other unlawful behavior that may create a hostile work environment and expose the organization to liability.

The use of copyrighted materials, unfounded or derogatory statements or misrepresentation will not be viewed favorably by the organization and can result in disciplinary action up to and including employment termination. EXCEL ER encourages you to write knowledgeably, accurately and using appropriate professionalism. Despite disclaimers, your web interaction can result in members of the public forming opinions about our organization and its employees and services.

Honor the privacy rights of our current employees by seeking their permission before writing about or displaying internal organization happenings that might be considered to be a breach of their privacy and confidentiality.

Your Legal Liability Component of the Blogging Policy

Recognize that you may be legally responsible for anything you write or present online. Employees can be disciplined by the organization, up to and including termination of employment, for commentary, content or images that are defamatory, pornographic, proprietary, harassing and libelous or that may create a hostile work environment.

Media Contact Component of the Blogging Policy

Media contacts about our organization and our current and potential employees, partners, patients, services or competitors should be referred for coordination and guidance to Encore Multimedia. This does not specifically include your opinions, writing and interviews on topics aside from our organization and our current and potential services, employees, partners, patients and competitors.

Guidelines for Business Hours:

While you are on company time, you must refrain from using company hardware, Internet, and email systems to engage with those who have no professional or business affiliation with the Company, including but not limited to social media, online shopping, personal email, etc.

Guidelines for EXCEL ER Guests or Participants:

By posting any content on EXCEL ER’ social media site you grant EXCEL ER the irrevocable right to grant EXCEL ER permission to reproduce, distribute and publish such content and the right to create derivative work, edit or modify and use it for any EXCEL ER purpose.

EXCEL ER reserves the right to monitor, delete, prohibit, restrict, block, suspend, terminate or discontinue access to any social media site at any time, without notice, if it determines , in its sole discretion, that such content is in violation of this or other policies of EXCEL ER.

Do not video and audio record or photograph inside EXCEL ER facilities or on campus, where the privacy of EXCEL ER’ staff or patients might be at risk.

You’re prohibited from providing any content on EXCEL ER social media sites that contains any product or service endorsements or any content that may be constructed as solicitation or political lobbying.

By posting or engaging in any activity on EXCEL ER social media sites you acknowledge that EXCEL ER is not responsible for you, third party personnel and sites, which choose to send confidential, personal, health information or other content. Also, EXCEL ER social media sites cannot be absolutely protected against intentional or malicious intrusion attempts. EXCEL ER does not permit and safeguard against any interception or compromise of your information that you or third party participants choose to share. Before posting content, be mindful in disclosing your or someone else’s privacy.

This policy may be updated or changed at any time without any notice. Each time the policy changes it will be in effect as of the day it is posted. To remain in compliance, EXCEL ER advises you to review the policy regularly and think twice before posting content. By continuing to post after the updated policy, you accept and agree to all modifications to this policy. The continuation of posting has same effect as if you had physically signed an agreement.
